MEANING OF SECTION 80G CERTIFICATE;80G CERTIFICATE

It is a certificate issued by Income Tax department to Non-Governmental Organization which includes Society, Trust and Section 8 Company. The donar gets 50% or 100%exemption from tax on the basis of this certificate. The main objective of 80G certificate is to attract more people to donate funds in that NGO which is registered under Section 80G of Income Tax Act, 1960. However, application for 12A registration should be applied first for obtaining registration under 80G though both the applications can also be applied simultaneously. Once the donation is received from donor, a receipt is issued by the organisation including Name, Date and PAN of NGO so as to let him avail exemption from tax.

REGISTRATION PROCESS

Submission of application by ePRO EXPRESS team along with necessary documents to exemption area of Income Tax department falling under the jurisdiction of that area for which license is proposed to be applied.
Once application is submitted then it will be checked and inspected by income tax department.
Income tax Department may ask for more documents and information if required.

MEANING OF SECTION 12A CERTIFICATE

Like 80G certificate, it is also issued by Income Tax department to Non-Governmental Organization which includes Society, Trust and Section 8 Company (hereinafter collectively referred as ‘NGO’). This certificate is granted to NGO to grant them exemption from paying income tax. Income earned by NGO is taxable as per slab rates if it is not registered under 12A. Hence, to get exemption from income earned by NGO, it is required get 12A certificate.

What is 80G and 12A??

Ans 80G is a certificate issued by Income Tax exemption department to grant exemption to donors of that NGO whereas 12A is a certificate issued by Income Tax exemption department to grant exemption to NGO’s income.

When NGO can apply 80G and 12A License??

Ans An application for 80G and 12A License can be applied anytime after NGO is registered.

Can NGO apply 80G and 12A application together??

Ans Yes, both the applications can be applied together or individually as per NGO requirement. However, if NGO wants to apply for 80G license then it also has to apply for 12A License first.

What is the eligibility to obtain 80G and 12A License??

Ans There are few conditions to obtain 80G and 12 A license which are as follows:

  • NGO should not have unexempted income generated from business
  • NGO should maintain regular book of accounts for business income
  • NGO should be the form of Section 8 Company/Society/Trust registered under specified act
  • NGO shall not use its income for purpose other than charity
  • NGO should not work for the benefit of particular section of the society instead it should work for the society as a whole.
  • NGO should maintain proper books of accounts of all receipts and expenditure

Is there any limit on tax exemption on donation??

Ans Yes there is a limit on tax exemption on donation which states that donation given by donor exceeds 10% of gross total income then the exceeding amount will not be eligible for tax benefit i.e. it becomes taxable.
