WHAT IS OSP CENTRE

OSP Centre is the infrastructure (located in India) used by the Service Providers for providing the services like Call Centre, Network Operating Centre, Tele-Medicine, Tele-Education, Tele-Trading, E-Commerce and other IT Enabled Services using telecom devices and service providers providing such service are known as Other Service Providers.

The service providers providing above stated services are required to apply for OSP Registration to Department of Telecommunication (DOT).

TYPE OF OSP Centres

‘Domestic OSP’ means the OSP providing Application Services within national boundaries.

‘International OSP’ means the OSP providing Application Services beyond national boundaries.

ELIGIBILITY OF OSP REGISTRATION

Only Private Limited Companies/LLP/ Foreign Company permitted by RBI are eligible to apply for OSP Registration. Thus, business person who intends to start a BPO or Call Centre or E-Commerce Business or other IT enabled services are compulsorily required to incorporate a Private Limited Company/LLP/ Foreign Company permitted by RBI before applying for OSP Registration.

TERMS & CONDITION FOR OSP OPERATION

  1. The OSP shall take the Telecom Resources from an Authorised Telecom Service Provider only.
  2. OSP may have internet connectivity from the Authorised Internet Service Provider.
  3. OSP is permitted to share the Telecom bandwidth with other activities of the same Company or group of companies.
  4. OSPs shall submit a copy of the network diagram approved by the Telecom Service Provider to VTM Cells for records and verification.

PROCEDURE TO APPLY FOR OSP REGISTRATION

An Applicant shall apply online on Saral Sanchar Portal. Before applying the same, applicants must register themselves and once registered system will send a unique applicant ID and  password to the registered Email id.

Now Application can login using login credentials mailed on registered Email ID. For first time login, immediately form of change password appears. Enter your new password and confirm same byentering again.

Press “Generate OTP” button. OTP will be sent to registered mobile number.Enter the OTP and press “Submit” button “password changedsuccessfully” massage will pop up.

Now by using the Registered Email ID and Password applicant can apply for Registration of OSP Centre by filling the application and attaching the requisite documents including affidavit and declaration.

DOCUMENTS REQUIRED FOR OSP REGISTRATION

The following documents are required to apply for OSP Registration in addition to application in the prescribed format:

  1. Certificate of Incorporation of Private Limited Company/LLP.
  2. Memorandum of Association (MOA) and Articles of Association (AOA) in case of Company and agreement in case of LLP.
  3. ID and Address Proof of Directors.
  4. Present shareholding pattern of the company (indicating Indian Equity & Foreign Equity).
  5. For Address Proof: Latest Electricity bill, NOC from Owner and Rent agreement (if premises are on rent).
  6. Network diagram – the OSP must clearly mention in the diagram whether it is using Sharing of Infrastructure or Centralized EPABX architecture or the CUG facility. Any change in the network is also required to be intimated immediately by the OSP without any delay.
  7. If interconnection of either one international OSP centre (Company A) with another international OSP centre (Company B) of Group companies is required. If so , whether in case group companies the following documents should be submitted.
  • Shareholding pattern of one international OSP centre (Company A)
  • Shareholding pattern of another international OSP centre(Company B)
  • Certificate from statutory Auditor of the company to certify that one international OSP centre (Company A) & another international OSP centre (Company B) are Group Companies.
  • Other supporting documents, if any like balance sheet, annual report etc. to establish that international OSP centre (company A) & another international OSP centre(company B) are Group Companies.
  1. If interconnection of either one domestic OSP centre (Company A) with another domestic OSP centre (Company B) of Group companies the following documents should be submitted.
  • Shareholding pattern of one domestic OSP centre (Company A).
  • Shareholding pattern of another domestic OSP centre(Company B).
  • Certificate from statutory Auditor of the company to certify that one domestic OSP centre (Company A) & another domestic OSP centre (Company B) are Group Companies.
  1. Other supporting documents, if any like balance sheet, annual report etc. to establish that domestic OSP centre (company A) & another domestic OSP centre(company B) are Group Companies.

FREQUENTLY ASKED QUESTIONS (FAQS)

What is the validity of OSP License??

The validity of OSP License is 20 years from the date mentioned in the license itself.

Is it possible to connect domestic OSP with international OSP??

No it is not allowed by DOT to connect domestic OSP with international OSP though interconnection of two or more domestic OSP Centres and two or more international OSP Centres of the same Company or group is possible.

Can an entity apply for more than One OSP License??

Yes, an entity can apply for more than One OSP License for multiple locations by providing the copy of OSP License already obtained for one location.

Can I transfer OSP License to another Company??

No, it is allowed to transfer OSP License. Another Company has to apply for another license.

What compliances are to be done after obtaining OSP License??

Once Registration Certificate is granted, OSPs are required to submit Annual Return to the Department of Telecommunication (DOT) within 6 months from the end of Financial Year. An Annual Return should state the activities undertaken during the year and the present status of OSP.

Further, OSPs must also comply with all the terms and conditions prescribed by the Department of Telecommunication
