Once a patent is registered, the inventor gets the exclusive right by patent department for commercial utilization of the invention made by him for limited period of time. Here the validity for patent registration is 20 years from the date of filing application which includes provisional as well as permanent patent. By registering an invention via patent, inventor gets the power of implementing that invention and not to allow any other person to use that idea for making or selling any product or service. The invention could be of anything like method to make a product or providing any service, development of software, making machine or any other technical item. However, an invention of the product or service must be unique and innovative that is one of its main factors that are taken into consideration at the time of approval. The other main factors are as follows:
- Originality: An invention should be new and should not be used publicly in any state of work before making patent application.
- Industrial Applicability:An invention must be capable to apply or use in the industrial process.
- Creativeness: Invention must be creative and non-obvious in nature. Also, it should be profitable to be patented.
