RERA REGISTRATION
One of the rules which is mandated by each state is to register the real estate project under RERA. RERA is applicable on persons including promoters and real estate agents according to following criteria:
- All those projects which have not received its Occupancy Certificate (OC) at the time of commencement of the Act i.e. 01st May, 2017 and every new project thereafter.
- No developer or builder shall advertise, market, book, sell or offer for sale, or invite persons to purchase any plot, apartment or building, in any real estate project or part of it, in any planning area, without registering their project with the Real Estate Regulatory Authority (RERA).
- Both commercial and residential projects are required to get registered under RERA.
Exceptions from registration under RERA:
- When Promoter has not received completion certificate for a real estate project; or
- When the area of land does not exceed 500 square meters or number of apartments does not exceed 8 (eight) inclusive of all phases; or
- Where the work is limited to repair/renovation/redevelopment hich does not involve marketing, advertising, selling or new allotment of any apartment, plot or building, under real estate project; or
Here promoter includes Developer, Development Authority, Builder, Society and Holder of Power of Attorney received from the owner
